The Digital Services Act (DSA, Regulation (EU) 2022\/2065) is an EU regulation that entered into force on November 16, 2022. This regulation aims to contribute to the proper functioning of the internal market for intermediary services by establishing harmonized rules for a safe, predictable and reliable online environment that promotes innovation and effectively protects fundamental rights enshrined in the Charter, including the principle of consumer protection.<\/p><\/div>

To the extent that Alessio Pellegrini's Netlogic Lab (referred to herein as \"Visit San Donato Val di Comino\") is an intermediary service provider under the DSA, the following applies:<\/p><\/div>

3. Transparency report in accordance with Articles 15 and 24 of the DSA.<\/h3>

The report. of transparency, which is to be made available once a year in accordance with Article 15(1) of the DSA and which includes the content moderations carried out during the annual period in question, is published here once a year after it has been drafted.<\/p>

The average number of monthly active users in the EU in the last six months according to Article 24 paragraph 2 of the DSA, was significantly below the determining threshold of 45 million users.<\/p><\/div>

4. Notification and redress procedure under Article 16 of the DSA.<\/h3>

Pursuant to Article 16 of the DSA, individuals and institutions have the right to report information about content they believe is illegal in our hosting services on this site, including online platforms.   4. A statement that the person concerned is convinced in good faith of the accuracy and completeness of the information provided in the notification.<\/li><\/ol><\/div>

    5. Internal complaint management system in accordance with Article 20 of the DSA.<\/h3>

    Visit San Donato Val di Comino may make certain restrictive decisions with respect to the content or accounts of users of our Brokerage Services, as provided by the DSA, if it determines that information provided to users constitutes illegal content or is inconsistent with the terms and conditions of the Platform. Visit San Donato Val di Comino may decide to:\u00a0<\/p>

    1. Restrict or block users' content or information;\u00a0<\/li>
    2. Suspend or terminate, in whole or in part, the provision of our services to users;\u00a0<\/li>
    3. Suspend or terminate the user's account;\u00a0<\/li>
    4. Restrict, suspend, or discontinue users' content monetization opportunities<\/li><\/ol>

      If you disagree with such a decision, you may file a complaint free of charge against such decision of Visit San Donato Val di Comino through our internal complaint handling system. Complaints may be filed within 6 months of receipt of the challenged decision via e-mail to the address info@netlogiclab.it<\/a>. Complaints are handled in a timely, non-discriminatory, careful and non-arbitrary manner under the supervision of qualified personnel. Once a decision is made, we will notify the complainant immediately.\u00a0<\/p><\/div>

      6. Possibility of out-of-court settlement of disputes under Article 21 of the DSA<\/h3>

      For the resolution of disputes relating to decisions made under our internal complaint handling system under Article 5, there is also the possibility of out-of-court dispute resolution before a so-called authorized out-of-court dispute resolution body under Article 21 of the DSA. Authorized out-of-court dispute resolution bodies are impartial and independent bodies expressly authorized by EU member states that, due to their capabilities and expertise, are able to examine disputes referred to them. Visit San Donato Val di Comino will cooperate with the out-of-court dispute resolution body in accordance with legal requirements. However, Visit San Donato Val di Comino is not bound by the decisions of the out-of-court dispute resolution body.<\/p>

      The possibility of out-of-court settlement of disputes is without prejudice to the right of the User concerned to go to court at any time, in accordance with applicable law, to challenge decisions.\u00a0<\/p><\/div>

      7. Measures and protection against misuse under Article 23 of the DSA.<\/h3>

      Visit San Donato Val di Comino, as an online provider, suspends the provision of services to users who often provide blatantly illegal content for a reasonable period of time upon notice. Visit San Donato Val di Comino suspends for a reasonable period of time upon notice the handling of reports and complaints received through its reporting and resolution procedures or internal complaint handling systems from persons or entities or complainants who often submit seemingly unfounded reports or complaints. In deciding on suspension, Visit San Donato Val di Comino shall promptly, carefully, and objectively assess, on a case-by-case basis, whether the user, person, institution, or complainant is implicated in misuse, taking into account all relevant facts and circumstances arising from available information. These circumstances, which Visit San Donato Val di Comino takes into account in assessing possible misuse and the appropriate duration of any suspension, include at least:<\/p>

      1. the absolute number of manifestly illegal content or manifestly unfounded reports or complaints provided or submitted within a given time period; \u00a0<\/li>
      2. their percentage of the total number of individual information provided or reported in a given period; \u00a0<\/li>
      3. The severity of instances of misuse, including the nature of the offending content, and their consequences; \u00a0<\/li>
